Our Chantix Lawyers Review the FDA Actions, "Early Communication" and "Public Health Advisory" Leading to Pfizer Warnings Resulting from Adverse Reaction Reports of Neuropsychiatric Symptoms including Depression, Suicidal thoughts, and Suicide.
The investigation undertaken by our Chantix lawyers and drug product liability attorneys has involved review of government information, scientific analyses and conclusions, as well as government action, advisories and warnings here in the United States, in Europe, Australia and elsewhere, all concluding that there was ample evidence of a likely association between Chantix and severe neuropsychiatric events including suicide and suicidal behavior.
Our Chantix lawyers have taken note of the increasingly strong statements of the US Food and Drug Administration as the agency has reviewed the available information including Chantix adverse reaction reports of psychiatric mood and behavioral symptoms including suicide and suicidal thoughts. Significant to our Chantix attorneys, following an initial "Early Communication for Chantix" noting that Pfizer had submitted reports of "suicidal ideation" in addition to a case of an individual on Chantix who had "engaged in erratic behavior," the FDA issued a much stronger "Public Health Advisory."
The "Public Health Advisory" followed its evaluation of the post-marketing Chantix adverse reaction reports as they related to changes in behavior, agitation, depressed mood, suicidal ideation, and actual suicidal behavior. Significant in its support of the conclusions of our Chantix lawyers initial analyses, the FDA Public Health Advisory stated: "[I]t appears increasingly likely that there may be an association between Chantix and serious neuropsychiatric symptoms." The FDA urged Pfizer to reevaluate its warnings in light of this data and indicated that it was working with Pfizer to arrive at appropriate warnings. The FDA urged patients to talk with their doctors about the risks of using Chantix relative to its benefits, and recommended that "health care professionals should closely monitor patients for behavior and mood changes if they are taking this drug." The FDA advisory stated in part:
"Health care professionals, patients, patients' families, and caregivers should be alert to and monitor for changes in mood and behavior in patients treated with Chantix. Symptoms may include anxiety, nervousness, tension, depressed mood, unusual behaviors and thinking about or attempting suicide. In most cases, neuropsychiatric symptoms developed during Chantix treatment, but in others, symptoms developed following withdrawal of varenicline therapy."
While the FDA was pressuring Pfizer to warn its consumers of the neuropsychiatric risks, our Chantix lawyers were notified that the Veterans Administration was warning thousands of our present and former servicemen who were receiving Chantix, including as a part of a VA study on the drug, that the drug had the potential to cause neuropsychiatric symptoms including depression, suicidal thoughts, and suicide.
As our Chantix lawyers reviewed the actions taken by other governmental agencies we found that there was a growing consensus that Pfizer's anti-smoking drug was associated with severe psychiatric symptoms including in particular depression, suicidal ideation and suicide. For example, the European Medicines Agency, EMEA, arrived at the same conclusion in part based upon information developed by the EU's "Committee for Medicinal Products for Human Use, CHMP.
Our Chantix lawyers note that after initially resisting the pressure to change its product labeling, and while still denying that a "causal relationship" had been established, Pfizer ultimately agreed to warn of the serious neuropsychiatric symptoms associated with use of Chantix. Specifically, Pfizer announced that the Chantix labeling would be changed to include new warnings advising doctors to monitor patients for changes in behavior, including depressed mood, agitation, suicidal thoughts and suicidal behavior.
Our Chantix Attorneys Describe Briefly the Neurological Mechanism of Action of Chantix as Providing Rational Basis for Causal Association With Neuropsychiatric Symptoms, Depression, Aggression, Suicidal Thoughts and Suicide.
Chantix is a legitimate pharmaceutical with a two-fold psycho-chemical mechanism of action. The first mechanism of action blocks nicotine from stimulating "receptors" in the brain which would otherwise result in the release of dopamine, a neurotransmitter which has a "feel good" effect. Simultaneously Chantix itself stimulates the release of small amounts of dopamine in the brain so that the user, who is withdrawing from cigarettes with Chantix, doesn't feel the absence of this "good feeling" which would occur if there were an abrupt reduction in dopamine levels. For our Chantix attorneys this is significant because the fact that it is demonstrated that Chantix has an actual pharmacological effect on the brain provides the initial plausible nexus between the use of Chantix and the neuropsychiactric symptoms that are demonstrated in the adverse reaction reports. Further research will be required to identify whether it is the intended or an unknown neurological mechanism of action which accounts for the Chantix neuropsychiatric side effects.

*Most Recent Product Liability Jury Verdicts and Settlements:
$2.7 million dollar jury verdict in a drug product fraud case in which attorney Henke represented 5 plaintiffs in a single consolidated 4 month trial alleging a conspiracy to defraud his clients with ineffective and dangerous AIDS drugs. Mr. Henke's experts in the case included Luc Montagnier, the discoverer of HIV and head of France's National AIDS Laboratories; Michael Gotlieb, the discoverer of AIDS and co-founder of the American Foundation for AIDS Research, Don Francis, the head of the first CDC AIDS Task force and discoverer that AIDS was a sexually transmitted disease, John Curnutte, head of the largest AIDS vaccine project in the world, Roger Detels, Chairman of the Epidemiology Department at UCLA and chief investigator on the largest AIDS epidemiology study in the United States, and a dozen others of the most highly respected AIDS scientists and physicians in the world. Mr. Henke also testified before Congress with regard to these cases, at the invitation of the Chairman of the Judiciary Committee of the United States House of Representatives.
$1.5 million dollar settlement in a pharmaceutical product liability birth injury case involving a drug which attorney Henke claimed was the probable cause of the child's birth injuries, based upon the facts that the child's mother's obstetrician provided her a sedative during early pregnancy. Mr. Henke's firm obtained possession of a list of physicians, which included the mother's obstetrician, who served as "investigators" in clinical trials involving a drug which was later determined to have been a very powerful teratogen; and the child was born with limb defects typical of the kind of birth defects which were caused by the particular teratogen. The settlement was achieved despite the fact that the medical records were unavailable 20 years after the birth and retirement of the obstetrician; and the mother did not recall the name of the sedative which was provided to her. Attorney Henke also obtained a $100,000 settlement from the physician who provided her the sedative. The applicable statutes of limitation had long passed by the time the client contacted Mr. Henke's office. Attorney Henke was able to overcome the statute of limitations, over the demurrers of both the pharmaceutical company and physician, by successfully alleging that they had intentionally concealed from the public and from the child's mother that they had distributed the drug.
