On one or more pages, Mr. Henke has referred to his co-authorship of one of the most significant articles in the legal literature on the subject of the falsity of the factual premises upon which medical malpractice tort reform legislation has been enacted. As a medical malpractice lawyer, Mr. Henke has felt that this tort reform legislation has had a very serious impact upon the degree to which victims of medical malpractice can obtain qualified legal counsel to represent them. Medical malpractice tort reform legislation, such as MICRA in California, commonly restricts that amount of general damages a client can recover, so that in California, for example, a patient rendered quadriplegic by the error of a physician, for example, would be limited to recoverying $250,000 in general damgages, meaning for his pain and suffering and for his lifetime loss of enjoyment of life damages. Also attorneys fees are commonly limited, as in California, making it unreasonable for medical malpractice attorneys to take on many worthy good medical malpractice cases, just because the cost and time commitment required to process the litigation cannot be justified by the restricted attorneys fees permitted.
The article referred to elsewhere, and above, as co-authored by one of the most highly regarded academics publishing on health science in the United States, is Henke & Neubaurer, “Crisis Revisited Ten Years After: An Expose on the False Premises for Medical Malpractice Legislation,” published in "Trial," the Journal of the American Trial Lawyers Association, January 1985. Mr. Henke's co-author, Deane Neubaurer, at that time was a Professor and the Dean of Social Sciences at the University of Hawaii, and one of the most published academics in the United States on trends in health care, author of more than a dozen other articles on health care, most published in scientific journals, as well as author, editor or coeditor of books on health care. He received his Ph.D. from Yale University, receiving the following fellowships, Fulbright Fellowship (England), (declined), Woodrow Wilson Fellowship, Sloan Fellowship, Yale University, Woodrow Wilson Dissertation Fellowship, Carnegie Fellowship Social Science, National Science Foundation Faculty Fellowship, University College, London. In addition to serving as a Professor and Dean of Social Sciences, he was also a consultant to the Rand Corporation, Department of Economics.
