The scientific evidence that has persuaded our Requip lawyers that the drug is responsible for causing many who use it to develop compulsive gambling disorders and other compulsive disorders is twofold (1) the epidemiological literature demonstrating the increased incidence of gambling and other compulsive disorders in association with Requip use; and (2) the similarity in category of drug, dopamine agonist, and the similarity in the "mechanism of action" of Requip to that of another dopamine agonist, Mirapex, which was previously demonstrated epidemiologically to cause gambling and other compulsive disorders.
The mechanism of action of Requip is to mimic a neurotransmitter, dopamine, and is therefore useful in treating some of the symptoms of Parkinsons disease, including the tremors characterizing the disease. In 2005 Requip was also approved by the Food and Drug Administration for use in patients with Restless Legs Syndrome (RLS). Since dopamine also serves to reinforce how the brain reinforces certain behaviors with sensations of pleasure, our Requip lawyers review the scientific evidence as convincing that dopamine agonists, such as Requip, also reinforce activities such as gambling with increased feelings of pleasure. Dopamine agonists have these chemical side effects, often previously interpreted as psychological addictions, among other things because one common sensation associated with the drug is the excitement, similar to a natural excitement, or "rush," as would be associated with receiving a reward, so that gambling and other experiences perceived as rewarding may become a compulsion disorder. Requip, just as other dopamine agonists, such as Miripex, has the effect to impair impulse control, so that those receiving the drug may not be able to control their impulse to gamble or eat or control other desires. Those who once gambled responsibly, for example, may spend more time gambling, or may have the impulse to seek a greater "high" by gambling greater amounts of money.
As our Requip attorneys have observed, compulsive gambling can lead to devastating consequences, the loss of wealth, debt, bankruptcy, divorce, broken families, all the while the patient and family unaware that his behaviors have been altered by the effects of this drug on his brain - until it is too late. In one recent case, a physician who received the drug lost 14 million dollars gambling at casinos across the nation.
Our Requip lawyers have reviewed all the scientific literature identifying similar behavioral changes in those who took the drug Mirapex, a drug which has the same dopamine agonist mechanism of action and had the same effect on those who took it, to impair their impulse control, leading to compulsive gambling and other obsessive compulsive disorders. As early as 2003 it was discovered by researchers at Muhmmad Ali Parkinson Research Center that patients receiving Mirapex were developing gambling addictions. The Mayo Clinic, reported in 2005 that 14 patients receiving Requip and other dopamine agonists had developed gambling addition. And then in what our Requip attorneys consider to be a very important study, researchers in 2008 described at an International Congress of Parkinsons Disease and Movement Disorders conference in Chicago that 13 percent of a large study group of 3000 patients receiving dopamine agonists were found to suffer at least 1 of 4 compulsive behaviors.
From a legal standpoint, our Requip attorneys consider it negligent and a matter of strict liability for GlaxoSmithKline to have failed to warn those receiving the drug of the propensity of Requip to result in gambling addition and other compulsive disorders. The manufacturer should have anticipated that its dopamine agonist would have the same side effects as the similar dopamine agonist, Mirapex, the two having the same likely mechanism of action, and with as background the body of scientific evidence generally on the functions of dopamine in the brain and hence the side effects to be anticipated with drugs which mimic the neurotransmitter. Even as the evidence mounted both with regard to Mirapex and Requip, GlaxoSmithKline failed to warn of the increased incidence of compulsive gambling and other obsessions associated with its dopamine agonist. It is for this reason that our Requip lawyers consider that lawsuits against GlaxoSmithKline will establish the manufacturer's liability for the gambling losses, the pain and suffering associated with addictions, the damage to family relationships, and other consequential damages.

The settlement was achieved despite the fact that the medical records were unavailable 20 years after the birth and retirement of the obstetrician; and the mother did not recall the name of the sedative which was provided to her.
